Eyeglass Rescue, Inc.’s (ERI) product and services are an eyewear identification system consisting of ERI’s Identification and Protection Sleeves, and an associated retrieval service. In consideration for the acceptance of your purchase of or registration with an Eyeglass Rescue™ (ER) product or service, you agree to be bound by the following terms and conditions: You expressly agree that use of an ERI product or service is your sole risk. Neither ERI, nor its successors, assignees, transferees, affiliates, nor any of their officers, directors, or employees, agents, third-party providers, or any other related parties, warrant that ERI will be uninterrupted or error-free; nor do they make any warranty as to the results that may be obtained from the use of ERI, or as to the accuracy, reliability or currency of any information, content, products or services provided through ERI. Under no circumstances shall ERI or any other party involved in creating, producing, providing or distributing ERI products or services, be liable for any direct, indirect, incidental, special, punitive, or consequential damages that result from the use of, or inability to use ERI products or services, or web site, or that result from mistakes, omissions, interruptions, delays in operation, or any failure of performance, whether or not resulting from acts of god. This includes, but is not limited to your reliance on any information obtained from ERI. Under no circumstances shall ERI be liable for damages to your eyeglasses resulting from exposure to heat from air, water, or anyway otherwise in the application or use of ERI’s products or services. You hereby acknowledge and agree that this paragraph shall apply to all content, products, and services available through ERI.

ERI’s products and services are available on an "as-is" and "as available" basis. ERI makes no representations or warranties of any kind, express or implied, as to ERI, its products or services. To the full extent permissible by applicable law, ERI disclaims all warranties, express or implied, including, but not limited to implied warranties of merchant¬ability and fitness for a particular purpose. No oral advice or written information given by ERI, nor its officers, directors, employees, agents, providers, or the like, shall create any other warranty, nor shall the user rely on any such information or advice.

When you place an order with ERI, you will be asked to supply certain information. You agree that all information that you provide will be accurate, complete and current. To facilitate the effectiveness of ERI’s products and services, you agree to notify ERI immediately of any changes in the information provided to ERI with your order or registration, including, but not limited to changes in your address, email address, or telephone number. ERI’s products and services are currently available only within the U.S.A. Any agreement relating to ERI, its products or services are void where prohibited. ERI reserves the right to limit the provision of any of its services or products to any person, geographic area or jurisdiction, in its sole discretion, and to limit the quantities of any of its products or services.

These terms and conditions and the respective rights and obligations of the parties hereunder, represents the entire understanding between you and ERI regarding your relationship with ERI and, as such, supersedes any prior statements or representations. They shall be governed by, and construed in accordance with, the laws of the Commonwealth of Massachusetts, U.S.A. The provisions of these terms and conditions are intended to be severable. If, for any reason any provision of these terms and conditions shall be held invalid or unenforceable in whole or in part in any jurisdiction, such provision shall, as to such jurisdiction, be ineffective to the extent of such invalidity or unenforceability without in any manner affecting the validity or enforceability thereof in any other jurisdiction or the remaining provisions hereof in any jurisdiction. These terms and conditions are subject to change without notice.

ERI’s products and services are registered with the United States Patent Office. Any attempt to copy or otherwise infringe upon ERI’s proprietary products and services will be aggressively prosecuted to the fullest extent that applicable laws allow.
